On April 23, 2024, the Federal Trade Commission passed a new regulation, called the Non-Compete Clause Rule or the "Final Rule." According to this rule, most non-competition clauses will be considered a violation of Section 5 of the Federal Trade Commission Act. The Final Rule will be effective 120 days after publication in the Federal Register.
